
Family of woman forced to transfer for medical assistance in dying takes case to court

The family of Samantha O’Neill, a 34-year-old woman who endured a painful ambulance transfer to receive medical assistance in dying (MAID), is taking their fight to B.C. Supreme Court. Joined by Dying With Dignity Canada and palliative care doctor Jyothi Jayaraman, they are challenging the right of faith-based hospitals to refuse MAID, even while receiving public funding. The case argues that these policies violate Canadians’ Charter rights by forcing vulnerable patients to suffer based on religious beliefs they may not share. The outcome could reshape how MAID is offered across the country and determine whether publicly funded religious facilities must provide the procedure on-site.
